Such wrongdoing includes conduct that poses a serious risk to public health and safety. Therefore, you should have <a href=\"https:\/\/legalvision.co.nz\/employment\/how-to-ensure-your-new-zealand-workplace-is-safe\/\">workplace policies<\/a> and systems in place to prevent and detect it. Sometimes, your employees are in the best position to report serious wrongdoing or misconduct in your workplace, as they are often the ones who witness it. It is critical to create a <a href=\"https:\/\/legalvision.co.nz\/employment\/3-key-employment-policies-every-business-needs\/\">speak-up culture<\/a> in your workplace. Some of the main reasons for the lack of reporting by employees include not knowing that whistleblowing policies are in place or being afraid of disciplinary action against them. This article explains what whistleblowing is and how to create a speak-up culture in your workplace to encourage your employees to report any workplace wrongdoing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is Whistleblowing in the Workplace?<\/h2>\n\n\n\n<p>When one of your employees witnesses serious wrongdoing in your workplace, they have a right under New Zealand law to make a protected disclosure. So long as they are acting in good faith, their disclosure is known as whistleblowing.<\/p>\n\n\n\n<p>A person commits serious wrongdoing when they engage in acts that involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>using public funds or resources in an unlawful, corrupt, or irregular way;&nbsp;<\/li>\n\n\n\n<li>causing (including omissions) a serious risk to public health or safety or the environment;&nbsp;<\/li>\n\n\n\n<li>causing (including omissions) a serious risk to the maintenance of law;&nbsp;<\/li>\n\n\n\n<li>committing a criminal offence; or<\/li>\n\n\n\n<li>if the person is a public official, engaging in an oppressive, improperly discriminatory or grossly negligent act (including omissions).<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>You should outline the process for making a protected disclosure in your workplace policies. If you do not have a whistleblowing policy in place (only public sector agencies must do so in New Zealand), your employees can make a protected disclosure directly to you as the head of the organisation.<\/p>\n<\/div>\n\n\n\n<p>However, you may be involved in the wrongdoing or have not taken any action after 20 working days following the disclosure. In this case, your employee can contact other \u2018appropriate authorities.\u2019 The <em>Protected Disclosures (Protection of Whistleblowers) Act 2022 <\/em>defines \u2018appropriate authorities\u2019 to include bodies such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the <a href=\"https:\/\/www.ombudsman.parliament.nz\/resources\/making-protected-disclosure-guide-blowing-whistle\">Ombudsman<\/a>;<\/li>\n\n\n\n<li>Commissioner of Police;<\/li>\n\n\n\n<li>Director of the Serious Fraud Office; and&nbsp;<\/li>\n\n\n\n<li>Inspector-General of Intelligence and Security.<\/li>\n<\/ul>\n\n\n\n<p>Within your whistleblower policy, you should include terms outlining:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who has access to whistleblowing protections in your organisation;&nbsp;<\/li>\n\n\n\n<li>what are protected disclosures;<\/li>\n\n\n\n<li>how your employees should make a protected disclosure;<\/li>\n\n\n\n<li>steps to ensure the employees involved in protected disclosures receive fair treatment;<\/li>\n\n\n\n<li>how your business supports and protects whistleblowers;<\/li>\n\n\n\n<li>how you will investigate any allegations; and<\/li>\n\n\n\n<li>where the policy is available.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How Are Your Employees Protected Under NZ Law?<\/h2>\n\n\n\n<p>Unless your employees disclose information with <a href=\"https:\/\/legalvision.co.nz\/disputes-and-litigation\/legal-privilege\/\">legal professional privilege<\/a>, their disclosures have protection under the<em> Protected Disclosures (Protection of Whistleblowers) Act 2022<\/em>. When investigating a case, you must keep the whistleblower\u2019s identity confidential. Exceptions are if it is critical to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>disclose the identity to conduct the investigation effectively; or<\/li>\n\n\n\n<li>prevent serious risk to public health or safety or the environment.<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>In New Zealand, the law protects whistleblowers from:<\/p>\n<!-- wp:list -->\n<ul><!-- wp:list-item --><\/p>\n<li>civil liability (e.g. any legal action against the whistleblower for breach of an employment contract, confidentiality or another contractual obligation);<\/li>\n<!-- \/wp:list-item --> <!-- wp:list-item -->\n<li>criminal liability (e.g. attempting to prosecute the whistleblower for unlawfully releasing information); and<\/li>\n<!-- \/wp:list-item --> <!-- wp:list-item -->\n<li>administrative liability (e.g. disciplinary action for making the disclosure).<\/li>\n<p><!-- \/wp:list-item --><\/ul>\n<p><!-- \/wp:list --><\/p>\n<\/div>\n\n\n\n<p>Failing to respect your employees\u2019 rights may result in a legal dispute, as they have a right to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>raise a personal grievance against you under the
