One such remedy is an interlocutory order. However, it can be confusing whether this remedy is appropriate for your business and your court case. This article will define an interlocutory order and explain some key concepts about applying for one.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Definition of Interlocutory Orders<\/h2>\n\n\n\n<p>An interlocutory order is an order made by the <a href=\"https:\/\/legalvision.co.nz\/disputes-and-litigation\/how-new-zealands-court-system-works\/\">District Court or High Court<\/a>. A court may award one for either an ongoing or eventual proceeding. The order should be related to some matter around relief or a procedural step. These matters will be secondary and related to your main court case. The interlocutory order may concern:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>securing a new trial, for the same matter or a different issue;<\/li>\n\n\n\n<li>striking out either the whole or part of an existing pleading, such as a guilty pleading; or<\/li>\n\n\n\n<li>changing a previous interlocutory order.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Interlocutory Order Applications<\/h2>\n\n\n\n<p>A judge can choose to make an interlocutory order, or a party may successfully apply for one. These two methods are discussed below. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Judge\u2019s Initiative<\/h3>\n\n\n\n<p>A judge may give leave for an interlocutory order where they think it is necessary, even if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>neither party specifically makes a claim for the order; or<\/li>\n\n\n\n<li>there is no current claim for relief.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">A Party<\/h3>\n\n\n\n<p>A party, such as you, may choose to file an interlocutory application to seek relief. This application must clearly state:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the type of relief you are seeking;&nbsp;<\/li>\n\n\n\n<li>the grounds that justify this relief, which would include reference to the law, a principle of law or a previous court decision; and<\/li>\n\n\n\n<li>a synopsis of your argument.<\/li>\n<\/ul>\n\n\n\n<p>This synopsis must contain:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a description of the general nature of the case;<\/li>\n\n\n\n<li>a chronological series of events of the case\u2019s facts;<\/li>\n\n\n\n<li>your key submissions or arguments; and<\/li>\n\n\n\n<li>any relevant documents, authorities and evidence, which you must present using a truthful written statement (<a href=\"https:\/\/legalvision.co.nz\/disputes-and-litigation\/what-is-an-affidavit-in-new-zealand\/\">an affidavit<\/a>).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>After you <a href=\"https:\/\/legalvision.co.nz\/disputes-and-litigation\/where-to-file-documents-in-high-court-proceeding\/\">file a successful application<\/a> with either the District Court or High Court, the court registrar will allocate you a hearing date for your application. They can oppose the application by providing a notice of opposition, which they must file with the court. They must give the notice to every party involved within:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ten working days after you distribute the application; or<\/li>\n\n\n\n<li>three working days before the hearing, if the hearing date is within that ten-day period.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>This notice of opposition must include an acknowledgement that the respondent intends to oppose the application. It will also outline the grounds for this opposition.<\/p>\n\n\n\n<p>Finally, the respondent must provide a synopsis of their argument at least one working day before the hearing. This synopsis will include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>any facts that you did not include;&nbsp;<\/li>\n\n\n\n<li>any facts that the respondent disputes;<\/li>\n\n\n\n<li>the respondent\u2019s key arguments; and&nbsp;<\/li>\n\n\n\n<li>any other relevant documents.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Interlocutory Hearing<\/h2>\n\n\n\n<p>The hearing will usually occur in the courtroom. However, the judge can request it take place through phone call or video. The parties involved can also apply for a remote hearing. This hearing will determine whether the applicant is successful in being awarded an interlocutory order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Interlocutory Application Without Notice<\/h2>\n\n\n\n<p>When applying for an interlocutory order, you usually have to provide the other parties with a notice of the application. However, there are circumstances where you may wish to make an application to a judge without the knowledge of the other parties. This is known as an interlocutory application without notice.&nbsp;<\/p>\n\n\n\n<p>To get an order without notice, you must take all reasonable steps to ensure that the application covers all relevant material and complies with the requirements of a usual interlocutory application.&nbsp;<\/p>\n\n\n\n<p>As the other party does not have an opportunity to respond, you also need to include any defences or facts that the respondent may rely on.
