This includes:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\"><a href=\"https:\/\/legalvision.co.nz\/intellectual-property\/maintain-patent-new-zealand\/\">patents<\/a>;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">designs;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">trade marks;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">geographical indications; and&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">plant variety rights.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Another form of intellectual property available in New Zealand is copyright, however this is not registrable and applies automatically for certain works you create.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">By protecting your intellectual property, you obtain the e<\/span><span style=\"font-weight: 400\">xclusive right to use, sell or license your intellectual property right. However, it can be difficult to determine which intellectual property right is best for you. This article explores the different intellectual property rights in New Zealand.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Patents<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">A <\/span><a href=\"https:\/\/legalvision.co.nz\/intellectual-property\/how-to-apply-for-patent-protection-in-new-zealand\"><span style=\"font-weight: 400\">patent is an intellectual property right<\/span><\/a><span style=\"font-weight: 400\"> for an invention. A patent provides you with the exclusive right to exploit your invention, including stopping others from:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">making;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">using; or&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">selling your invention.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">This protection lasts twenty years provided that you pay the appropriate renewal fees. A New Zealand patent provides you with patent protection within New Zealand.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">A patent in New Zealand must:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">have novelty;&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">have an inventive step; and&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">be useful.&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">In the event you disclose your invention before filing a patent application in New Zealand, there is a twelve month grace period for limited public disclosure. This includes unauthorised disclosure or reasonable trial of the invention. We recommend you contact your local law society.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Designs<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">A design protects the:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">shape;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">pattern;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">ornamentation;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">feature; or&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">configuration of a product, whether two dimensional or three dimensional.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">In saying this, a design protects the way something looks, rather than how it works, which can be protected by a patent. A design provides you with the exclusive right to exploit your design, including stopping others from: <\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">making<\/span>;<\/li>\n\n\n\n<li><span style=\"font-weight: 400\">using; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">selling products that utilise your design<\/span>.<\/li>\n<\/ul>\n\n\n\n<p>This lasts<span style=\"font-weight: 400\"> fifteen years<\/span> as long as you pay<span style=\"font-weight: 400\"> the appropriate renewal fees<\/span>.<span style=\"font-weight: 400\"> A New Zealand design provides you with design protection within New Zealand.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">A New Zealand design must be:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">new; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">original.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Once a New Zealand design application is filed, it will undergo a formal examination and be assessed against the prior art base to determine whether it is new and original. If so, the <\/span><span style=\"font-weight: 400\">Intellectual Property Office of New Zealand (IPONZ) will register the design in New Zealand.
