Common orders include monetary awards requiring one party to pay compensation or damages to another, typically capped at $30,000. The Tribunal may also issue orders requiring specific performance, such as completing contracted work, returning goods, or rectifying defective services. Additionally, the Tribunal can make orders for the return of property, require parties to take or refrain from certain actions, or issue declaratory orders clarifying legal rights and obligations.<\/p>\n\n\n\n<p>This article outlines how you can enforce an order from the Disputes Tribunal. <br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">1. Contact the Other Party<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">If the other party has failed to comply with the tribunal order, you should contact them. The Disputes Tribunal will not check to see if the other party has abided by its decision. That is why you must obtain the other party\u2019s contact details during the dispute process. These details include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">a home and work address;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">a phone number;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">an email address; and<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">the details of any vehicles they own.\u00a0<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">You can write a letter or email to this party detailing:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">that they have not complied with the tribunal order; and<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">the steps you will take if th<\/span>e other party does not comply with the<span data-preserver-spaces=\"true\"> order.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">Alternatively, you can get your business\u2019s lawyer or representative to write a formal letter on your behalf.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">It is against the Disputes Tribunal rules to enforce the tribunal order until the deadline in the decision issued by the Tribunal has passed. However, if the order requires that party to complete work, the Tribunal will be able to order that party to pay you instead.\u00a0<\/span><\/p>\n\n\n\n<div class=\"box box--info box--icon\">\n<p><span data-preserver-spaces=\"true\">For example, the other party was required to repair the damage that they inflicted to your business\u2019s premises or complete work that they were contracted to do.
