These messages can be:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\"><a href=\"https:\/\/legalvision.co.nz\/e-commerce\/legal-considerations-email-marketing\/\">emails<\/a>;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">faxes;&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">instant messages; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">mobile text messages.&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Internet pop-ups or telemarketing, such as phone calls, are not <\/span>part of<span style=\"font-weight: 400\"> the definition of spam.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">These messages have to be commercial in nature to count as spam. That means that the message must market or promote a:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">good;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">service;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">land or interest in land; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">an investment opportunity, or contain a link to one of these categories.&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The message will still be spam, even if these goods or services are free.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">A singular message sent to one person can count as spam. The message does not have to be sent or received in bulk.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Is Excluded From the Definition of Spam?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">There is a range of messages that the definition of commercial electronic messages does not include. These are messages that:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">provide a requested quote for the <\/span><a href=\"https:\/\/legalvision.com.au\/what-to-look-for-supply-agreement\/\"><span style=\"font-weight: 400\">supply of goods or services<\/span><\/a><span style=\"font-weight: 400\">;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">facilitate a commercial transaction that the recipient agreed to enter into with your business;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">provides warranty, product recall or safety information about goods or services that the recipient purchased from your business;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">i<\/span>nclude <span style=\"font-weight: 400\">factual information about the recipient\u2019s ongoing subscription, membership or account loan to your business or your business\u2019s services;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">provides information about an employment relationship that the recipient is in;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">delivers goods or services, such as an upgrade, that the recipient is entitled to from a previous transaction with your business; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">provides the recipient with information about goods or services supplied by a government body, court or tribunal.&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<p><span
