What Contracts Do I Need?"},"content":{"rendered":"\n<p><span data-preserver-spaces=\"true\">If you own a small or medium-sized photography business, it can be difficult to work out exactly what legalities and documentation you need to manage your relationships with:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span data-preserver-spaces=\"true\">clients;&nbsp;<\/span><\/li><li><span data-preserver-spaces=\"true\">models; and&nbsp;<\/span><\/li><li><span data-preserver-spaces=\"true\">other people.<\/span><\/li><\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">While it might be tempting to solely focus on your photography, you need to protect yourself and your business.<\/span> If you do not have<span data-preserver-spaces=\"true\"> robust legal documentation<\/span>, you <span data-preserver-spaces=\"true\">a<\/span>re exposing yourself to legal risks.<\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">This article will look at three of the most common and most important agreements for photographers:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span data-preserver-spaces=\"true\">a basic client agreement;<\/span><\/li><li><span data-preserver-spaces=\"true\">terms of use for your website; and&nbsp;<\/span><\/li><li><span data-preserver-spaces=\"true\">model release forms.<\/span><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Is A Client Agreement?<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">All photography businesses should use client agreements of some description<\/span>. This document <span data-preserver-spaces=\"true\">should formally set out the terms on which you are working for individuals or businesses that are looking to use your services. This agreement can include a number of different provisions depending on what you will actually be doing. However, it should almost always include terms about:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span data-preserver-spaces=\"true\">the parties to the contract (is the other party an individual or a business?);<\/span><\/li><li><span data-preserver-spaces=\"true\">how your clients will pay you;<\/span><\/li><li><span data-preserver-spaces=\"true\">a detailed description of the services you will be providing (e.g. taking photos at a customer\u2019s wedding, editing, the final offering of photos etc.);<\/span><\/li><li><span data-preserver-spaces=\"true\">how any\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/legalvision.co.nz\/intellectual-property\/5-ip-assets\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">intellectual property rights<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0in your photos will be managed and licensed to the customer;<\/span><\/li><li><span data-preserver-spaces=\"true\">how you or the client can end the agreement in the event of a dispute; and\u00a0<\/span><\/li><li><span data-preserver-spaces=\"true\">the way you limit or exclude your liability under the agreement (e.g. for events out of your control or consequential losses). For example, if your camera breaks during a special event, you do not want to be held legally responsible for any disappointment or harm resulting from a lack of photos.<\/span><\/li><\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">You can include different terms depending on:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span data-preserver-spaces=\"true\">what is important to you; or <\/span><\/li><li><span data-preserver-spaces=\"true\">what you find typically results in issues based on your experience with past clients. <\/span><\/li><\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">Once you have a basic (or template) agreement with y<\/span>our chosen<span data-preserver-spaces=\"true\"> term<\/span>s<span data-preserver-spaces=\"true\">, you can adjust <\/span>it<span data-preserver-spaces=\"true\"> for each client.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Are Website Terms of Use?<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">A website\u2019s terms of use set out the rules for anyone who goes on your website. These terms typically include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span data-preserver-spaces=\"true\">how people can use your website<\/span>;<\/li><li><span data-preserver-spaces=\"true\">legal disclaimers; and <\/span><\/li><li><span data-preserver-spaces=\"true\">rules around what conduct is allowed and what is prohibited. <\/span><\/li><\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">Usually, one of the most critical clauses in a website\u2019s terms of use relates to how&nbsp;<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/legalvision.co.nz\/intellectual-property\/use-content-from-other-business-websites\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">users can use your content<\/span><\/a><span data-preserver-spaces=\"true\">. This is particularly important if you have a website that showcases your work by having lots of different photography available for visitors to your website to see.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Given the risk of someone taking or copying the photos on your website, you should ensure you have website terms of use in place and include a general prohibition on website visitors copying any content from your website without your consent. This means that anybody looking to use your photos (from your website) must seek your consent if they would like to do so. This provides you with a stronger legal basis if you discover that your content has been taken from your website.
