Recognising this, a relatively new New Zealand employment law provides people affected by family violence with certain legal rights, such as the ability to:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">take up to ten days of paid leave;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">ask for a short-term&nbsp;<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/legalvision.co.nz\/employment\/flexible-work-arrangements\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">flexible working arrangement<\/span><\/a><span data-preserver-spaces=\"true\">; and&nbsp;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">n<\/span>ot be treated adversely.<\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">This article sets out:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">what family violence leave is;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">what your business&#8217; obligations to affected staff are; and&nbsp;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">some tips around short-term flexible working arrangements.<\/span><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What is Family Violence Leave?<\/span><\/h2>\n\n\n\n<p>The Government put family<span data-preserver-spaces=\"true\"> violence leave and additional rights i<\/span>nto<span data-preserver-spaces=\"true\"> place to recognise the terrible burden that <\/span>family<span data-preserver-spaces=\"true\"> violence imposes. This includes the implications for people&#8217;s work and employment. Family<\/span> <span data-preserver-spaces=\"true\">violence can be:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">physical;&nbsp;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">sexual; or&nbsp;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">psychological.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">Recent changes to employment law provide employees affected by family<\/span> <span data-preserver-spaces=\"true\">violence with the right to:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">take up to 10 days of paid family violence leave each year. This is separate from\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/legalvision.co.nz\/employment\/annual-parental-leave\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">annual leave<\/span><\/a><span data-preserver-spaces=\"true\">, sick leave and bereavement leave. Employers can give more than the ten days required by law if they wish;<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">ask for short-term flexible working arrangements, for up to two months; and<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">not<\/span> to receive adverse<span data-preserver-spaces=\"true\"> treatment in the workplace because they might have experienced domestic violence. From a legal perspective, this is classified as discrimination.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">For the purposes of these new rights and entitlements, it does not matter when the family violence took place. Employees still have these rights if they experienced family violence before:\u00a0<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">they began working for their current employer; or<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">the law changed.<\/span><\/li>\n<\/ul>\n\n\n\n<div class=\"box box--info box--icon\">\n<p><span data-preserver-spaces=\"true\">Another important point is that employees can also take family violence leave to support a child who is or has been a victim of family violence. This is as long as the child usually or periodically lives with that employee. That is to say, the child does not need to be living with the employee all the time.<\/span><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Are My Business&#8217; Obligations?<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">Of course, employers have always had a good faith obligation to support their employees. This includes when they are affected by serious personal situations, such as those relating to family violence. The new law changes add to this by implementing specific rights for affected workers and some obligations for businesses.<\/span><\/p>\n\n\n\n<div class=\"box box--info box--icon\">\n<p><span data-preserver-spaces=\"true\">For instance, you must ensure that your employees can ask for, and have approved, family violence leave.<\/span><\/p>\n<\/div>\n\n\n\n<p><span data-preserver-spaces=\"true\">As an employer, note that you can decide to:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">offer more than the minimum ten days of paid <span data-preserver-spaces=\"true\">family<\/span> violence leave; or\u00a0<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">let an employee take annual leave, unpaid leave or <span data-preserver-spaces=\"true\">family<\/span> violence leave in advance when they have used all their paid <span data-preserver-spaces=\"true\">family<\/span> violence leave.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">However, when you decide to offer affected employees more than the minimum leave, you must record all of these arrangements in writing.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Short-term flexible work arrangements, and the obligation to make these available to affected employees, may require separate
