{"id":2028,"date":"2020-12-23T09:37:03","date_gmt":"2020-12-22T23:37:03","guid":{"rendered":"https:\/\/nz.legalvision.com.au\/?p=2028"},"modified":"2021-01-05T13:40:33","modified_gmt":"2021-01-05T00:40:33","slug":"acc-refund-accident","status":"publish","type":"post","link":"https:\/\/legalvision.co.nz\/employment\/acc-refund-accident\/","title":{"rendered":"What Is an ACC Refund For an Accident?"},"content":{"rendered":"\n<p><span style=\"font-weight: 400\">If you are involved in an accident and sustain an injury that is no-one\u2019s fault, the New Zealand government\u2019s personal injury scheme, the Accident Compensation Corporation (ACC), can help pay for:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">medical bills;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">treatment; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">can help cover your income if you <\/span><a href=\"https:\/\/legalvision.co.nz\/employment\/sick-leave-employees-new-zealand\"><span style=\"font-weight: 400\">cannot work<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">This article will explain when the ACC will cover you and when you will be entitled to a refund.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">When Does ACC Cover You?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">An accident means a specific event where:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">your body is subject to an external force; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">you move suddenly to avoid an external force.&nbsp;<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The term \u2018accident\u2019 also includes:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">breathing in or swallowing a gas, liquid or object on a specific occasion;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">burns (but not usually sunburn); and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">absorbing chemicals through your skin for up to one month.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Whilst ACC generally does not cover conditions that are caused gradually, rather than a one-off event, it will cover your injury if it is the result of something harmful that you are exposed to at work over a period of time, such as:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">hearing loss; or&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">asbestos.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">However, you will have to show that your work environment caused the injury.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">You will be able to claim a refund if you are a New Zealand citizen, resident or temporary visitor and your accident happened in New Zealand. ACC doesn\u2019t cover accidents that occur outside of New Zealand, even if you are a New Zealand citizen or resident.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Most claims for a refund involve physical injuries caused by an accident which is no one\u2019s fault. Some non-physical injuries, such as shock or stress, are covered too. If someone else\u2019s actions caused your accident, this would not be covered by ACC. Instead, you may be able to sue them in court for compensation.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">ACC will not pay for treatments or services for:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">pre-existing medical conditions;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">injuries that are unrelated to the injury you wish to claim for; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">if you deliberately injured yourself.<\/span><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Injuries That You Can Claim For<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The vast majority of injuries occur at home and in the community, whilst others happen at work, on the road, or when playing sport. Common examples include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">falling off a ladder;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">twisting your knee playing sport; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">car accident
