The law recognises the importance of ensuring employees receive at least the minimum entitlements during their workday, which is set out in the <em>Employment Relations Act<\/em>. For example, this is the case where public safety will be put at risk and no suitable person is able to provide cover.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Negotiating Breaks<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Employers and employees also have the reasonable opportunity to negotiate about timing and length of breaks in good faith. If meal breaks are unpaid, employers can agree that they will be for a minimum length, but employees can take longer breaks if both parties agree. This is common in the corporate sector, where lunch breaks are often one hour.\u00a0It is important that you do not refuse to let employees take breaks.\u00a0<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>Importantly, you must not include a provision in the <a href=\"https:\/\/legalvision.co.nz\/employment\/employment-agreement\/\">employment agreement<\/a> that removes or reduces minimum entitlements or compensation, as this has no effect and is not enforceable.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Compensation Instead of Breaks<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In limited circumstances, your business might provide compensation for breaks. The compensation must be reasonable and aim to compensate for failure to provide rest and meal breaks. It may include the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>time off work;&nbsp;<\/li>\n\n\n\n<li>allowing for a later start or earlier finish time; or&nbsp;<\/li>\n\n\n\n<li>financial compensation.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, if you provide financial compensation, this must correlate with the amount that the employee was working instead of having their break. Likewise, you should compensate an employee with, at least, their ordinary rate of pay. It is important to give proper compensation for untaken breaks, you should not pay someone extra or allow for them to leave early if an employee does not take their break.
