Where to file documents in the High Court is one of the most common questions we receive. Luckily, there are some general principles to follow that make the process more straightforward. This article sets out:&nbsp;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the basics of filing documents in the High Court;&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">where you should file them if you are making a claim or asking for an appeal; and&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">what you need to know about electronic filing.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400\">The Basics of Filing Documents<\/span><\/h2>\n<p><span style=\"font-weight: 400\">You need to file documents in New Zealand to start a legal proceeding. Precisely what is required depends on the kind of claim you are trying to make. The Ministry of Justice\u2019s website sets out what is required for each kind of claim. These include:<\/span><span style=\"font-weight: 400\"><br><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#general-civil-proceeding\"><span style=\"font-weight: 400\">general civil proceeding<\/span><\/a><span style=\"font-weight: 400\"> (looking to recover money or settle a dispute: this is the most common type);&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#judicial-review\"><span style=\"font-weight: 400\">judicial review<\/span><\/a><span style=\"font-weight: 400\"> (asking a judge to review the actions or decisions of a public body);&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#civil-appeal\"><span style=\"font-weight: 400\">civil appeal<\/span><\/a><span style=\"font-weight: 400\"> (asking the High Court to reconsider a decision, for instance from the District Court);<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#habeas-corpus\"><span style=\"font-weight: 400\">habeas corpus application<\/span><\/a><span style=\"font-weight: 400\"> (applying to have your imprisonment declared unlawful);&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#bankruptcy\"><span style=\"font-weight: 400\">bankruptcy application<\/span><\/a><span style=\"font-weight: 400\"> (applying to have someone declared insolvent or unable to pay their debts);&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#company-liquidation\"><span style=\"font-weight: 400\">company liquidation<\/span><\/a><span style=\"font-weight: 400\"> (applying to have a company&#8217;s assets given to its creditors);&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#probate-letters\"><span style=\"font-weight: 400\">probate and letters of administration<\/span><\/a><span style=\"font-weight: 400\"> (applying to administer a deceased person&#8217;s estate); and<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"https:\/\/www.justice.govt.nz\/courts\/going-to-court\/without-a-lawyer\/representing-yourself-civil-high-court\/starting-a-proceeding-in-the-high-court\/#interlocutory-application\"><span style=\"font-weight: 400\">interlocutory application<\/span><\/a><span style=\"font-weight: 400\"> (applying for a preliminary or secondary order).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Another important basic with filing documents is to remember you need multiple copies of each document. At the very least, you should have one copy for:&nbsp;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the court;&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the other party (or multiple if there are multiple parties); and&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">yourself.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400\">Where to File Documents in a New Zealand Proceeding<\/span><\/h2>\n<p><span style=\"font-weight: 400\">When you are filing a document to begin a new proceeding, you typically need to file your application in the High Court registry (court) closest to the defendant\u2019s home or place of business. The defendant is the person you are taking the proceeding against. You should file in the registry closest to the primary defendant in circumstances where there is more than one defendant. A registry is basically like the court\u2019s administrative office.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, it is a bit more confusing if you are filing an appeal to try and overturn a decision in the District or Family court. If so, you should file it:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">in the closest High Court registry to where the hearing of the previous decision you are appealing took place; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">if there was no hearing, in the closest High Court registry to where the decision you are appealing was given; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">in any High Court registry that you and the other parties agree to (if all parties agree that you should file an appeal should be in a different registry to the one above, you should file a memorandum recording your agreement with the High Court).<\/span><\/li>\n<\/ul>\n<div class=\"box box--info box--icon\">\n<p><span style=\"font-weight: 400\">If you are defending a claim (rather than filing one), you should file all your documents in the High Court registry where the other side started the proceeding. However, you may believe that the party filed the proceeding in the wrong registry or that another court&#8217;s registry would be more appropriate.
