When you file a statement of claim to describe your legal problem and the facts of what happened, you also need to file a notice of proceeding to tell the other party that you are taking legal action against them. This article sets out:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>what a notice of proceeding is;&nbsp;<\/li>\n\n\n\n<li>what must be included in a notice of proceeding; and<\/li>\n\n\n\n<li>whether to attach a memorandum with the notice (and what to include in that memorandum).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Notice of Proceeding?<\/h2>\n\n\n\n<p>A notice of proceeding is a key document in NZ\u2019s legal system. It serves as the formal notification that legal action has been initiated. Its primary purpose is to inform the defendant that you are taking legal action against them. In judicial review proceedings, it notifies the body whose decision you are seeking review of that you are taking legal action in the District Court or <a href=\"https:\/\/legalvision.co.nz\/disputes-and-litigation\/where-to-file-documents-in-high-court-proceeding\/\">High Court<\/a>.<\/p>\n\n\n\n<p>Note the difference between a <a href=\"https:\/\/legalvision.co.nz\/disputes-and-litigation\/what-is-a-statement-of-claim\/\">statement of claim<\/a> and a notice of proceeding. These are separate documents that have different effects legally. A statement of claim sets out the details of your problem and legal claim. A notice of proceeding informs the other party that you are filing a claim against them, with a timeframe to respond. The other party (whether a natural person or business) then has an opportunity to file their own statement in the District Court or High Court.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why is a Notice of Proceeding Important?<\/h2>\n\n\n\n<p>A notice of proceeding ensures procedural fairness by allowing the other party to respond and prepare their defence. It sets in motion the legal process and triggers important timelines and procedural requirements.&nbsp;<\/p>\n\n\n\n<p>If you are the plaintiff, it represents the official commencement of your legal action. You must do this within 25 working days after the date on which you have been served with this notice. If you do not, the plaintiff may at once proceed to judgment on the plaintiff\u2019s claim, and judgment may be given in your absence.\u201d<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<\/div>\n\n\n\n<p>Your notice should also include the court\u2019s name and location where the proceedings are held. Typically, you file the proceeding in the court nearest where the defendant lives or conducts business. However, other factors can influence this decision and you may file in another location, based on:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>where the cause of action arose;&nbsp;<\/li>\n\n\n\n<li>the convenience of witnesses;&nbsp;<\/li>\n\n\n\n<li>the nature of the case; and&nbsp;<\/li>\n\n\n\n<li>relevant laws or agreements.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>You will also need to ensure you have clearly identified all parties with their full name and address.<\/p>\n\n\n\n<p>However, there is additional information that should also be attached. You should include this information in a memorandum sent with the notice of proceeding.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Do You Need to Attach a Memorandum?<\/h2>\n\n\n\n<p>Yes, you will need to attach a memorandum to your notice of proceeding. There are some rules that apply to what must be included in this memorandum. You need to cover information about:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Seeking Representation:<\/strong> This is particularly for companies that cannot represent themselves and so will need a solicitor to represent them in the proceeding.&nbsp;<\/li>\n\n\n\n<li><strong>Legal Aid:<\/strong> This includes whether the party&nbsp; may be entitled to it. Also, you must include an acknowledgment of whether you are applying for or receiving legal aid for the proceeding.&nbsp;<\/li>\n\n\n\n<li><strong>Filing a Statement of Defence:<\/strong> You should include the procedural rules for the other party filing a defence, including timings and where they should file.&nbsp;<\/li>\n\n\n\n<li><strong>Counterclaims:<\/strong> Include a notification that they must file any counterclaims in the same registry as the original claim.
