You need to inform customers about the important characteristics of the vehicle itself, as these will determine their decision. The law requires that you disclose certain information about your used vehicles so that customers can make a considered decision. This requirement is also to prevent <\/span><a href=\"https:\/\/legalvision.co.nz\/regulatory-and-compliance\/prevent-fraud-nz-business\/\"><span style=\"font-weight: 400\">fraud<\/span><\/a><span style=\"font-weight: 400\"> and discourage <\/span><a href=\"https:\/\/legalvision.co.nz\/regulatory-and-compliance\/what-is-misleading-or-deceptive-conduct-in-new-zealand\/\"><span style=\"font-weight: 400\">misleading sales tactics<\/span><\/a><span style=\"font-weight: 400\">. You set this information out in a Consumer Information Notice (CIN), which every dealer that sells used cars must include in their sales. This article will provide some background for when you need a consumer information notice in New Zealand and what a CIN should contain.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Is a Consumer Information Notice?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">A CIN is a sheet of paper (or section on a web page selling your used cars) that details essential information about the used vehicle you are selling, such as its history and price. This document needs to be accurate and complete. Otherwise, you run the risk of misleading your customers and facing penalties under the law.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Should a Consumer Information Notice Include?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">You need to ensure you display a CIN on every used vehicle you sell and that this document clearly outlines the information that the law requires. You need to include information about yourself as the dealer or seller. This includes your:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">name and address;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">business name; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">registration number, or auctioneers name if you sell at auction.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Your CIN also needs to display information about the car itself, which you can find through the <\/span><a href=\"https:\/\/www.nzta.govt.nz\/\"><span style=\"font-weight: 400\">New Zealand Transport Authority<\/span><\/a><span style=\"font-weight: 400\"> (NZTA) on the Motor Vehicle Register if you have missing records. If any of these details change, you need to update your CIN. This information includes:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">what year someone first registered the vehicle in New Zealand;<\/span><\/li><li>the <span style=\"font-weight: 400\">make and model;<\/span><\/li><li><span style=\"font-weight: 400\">the vehicle identification number (VIN) or chassis number;<\/span><\/li><li><span style=\"font-weight: 400\">the actual distance the vehicle has travelled, or if you think the odometer is inaccurate, a note saying so;<\/span><\/li><li><span style=\"font-weight: 400\">any security interests or other money owing on the vehicle;<\/span><\/li><li><span style=\"font-weight: 400\">t<\/span>he<span style=\"font-weight: 400\"> price, including GST and any other registration and licensing costs;<\/span><\/li><li><span style=\"font-weight: 400\">if applicable, whether the vehicle is for sale by auction;<\/span><\/li><li><span style=\"font-weight: 400\">whether any road user charges apply;<\/span><\/li><li><span style=\"font-weight: 400\">the engine capacity and make;<\/span><\/li><li><span style=\"font-weight: 400\">the fuel type;<\/span><\/li><li><span style=\"font-weight: 400\">the registration plate number;<\/span><\/li><li><span style=\"font-weight: 400\">whether the warrant\/certificate of fitness is current and its expiry date; When you sell a used vehicle, you need to give the customer a copy of the CIN before making the purchase and acknowledge in writing that you have done so. <\/span>Therefore, when<span style=\"font-weight: 400\"> the time comes to complete the purchase, you both need to sign the document.
