If you fail to do this adequately, you can run into both reputational losses and financial penalties. However, it can be difficult to determine what level of protection your personal information needs. Some kinds of identifying information will be more critical than others, so you may need more intensive security measures and protections. The New Zealand <\/span><i><span style=\"font-weight: 400\">Privacy Act <\/span><\/i><span style=\"font-weight: 400\">does not generally have specific requirements for handling <\/span><a href=\"https:\/\/legalvision.co.nz\/data-privacy-it\/privacy-policy-sensitive-information\/\"><span style=\"font-weight: 400\">sensitive information<\/span><\/a><span style=\"font-weight: 400\"> outside of a couple of situations. However, you still need to protect it appropriately. Therefore, for some guidance, this article will explain how New Zealand privacy law protects sensitive information.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Is Sensitive Information?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The <\/span><i><span style=\"font-weight: 400\">Privacy Act<\/span><\/i><span style=\"font-weight: 400\"> protects personal information. This kind of information is anything that can identify a person, whether it is by itself or with another piece of data. It cannot be about companies\/organisations or non-living individuals. Examples of this kind of data can include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">names;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">physical addresses;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">financial details, such as credit card numbers;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">photographs;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">email addresses; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">phone numbers.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">This definition is very broad and can include a variety of different kinds of information. It aims to allow for unexpected privacy breaches, given how fast information can spread due to technology.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">However, New Zealand law does not have a special definition for sensitive information. Other countries with similar privacy laws do have special legal protections for information of this nature. For example, Australian law includes the following as sensitive information:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">racial or ethnic origin;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">political opinions;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">religious or philosophical beliefs;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">sexual orientation or practices;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">criminal records;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">health information;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">genetic information; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">biometric information.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Organisations that handle these kinds of sensitive information have special restrictions in Australia.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Does New Zealand Have Extra Protections for Sensitive Information?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">New Zealand privacy law protects this kind of sensitive information as well (except for opinions), as long as it comes under the umbrella of \u201cpersonal information\u201d. Even so, it does not include extra obligations like Australian law might.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Nonetheless, that does not mean that there are not instances where you need to take the sensitivity of the personal information you hold into account.
