If so, you must be aware of all the rights you owe to your employees. New Zealand employment law governs most of these rights to ensure employers do not take advantage of their staff. For example, employees are entitled to <\/span><a href=\"https:\/\/legalvision.co.nz\/employment\/summary-of-leave-entitlements-new-zealand\/\"><span style=\"font-weight: 400\">varying amounts of leave<\/span><\/a><span style=\"font-weight: 400\">. However, there may be a situation where an employee has run out of leave but still wants to take leave. This article will explain your employees\u2019 entitlements to bereavement leave and what you can do if your employee has run out of bereavement leave.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Bereavement Leave<\/span><\/h2>\n<p><a href=\"https:\/\/legalvision.co.nz\/employment\/what-is-bereavement-leave-in-new-zealand\/\"><span style=\"font-weight: 400\">Bereavement leave<\/span><\/a><span style=\"font-weight: 400\"> is a type of leave that an employee can take in relation to a bereavement. For example, bereavement occurs in the following situations:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the death of an immediate family member;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">if an employee or their partner suffers a miscarriage or stillbirth.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">cultural responsibilities regarding death; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">overseeing the execution of a will.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Bereavement leave after a miscarriage or stillbirth also applies to parents having a child through adoption or surrogacy if the pregnancy ends by miscarriage or stillbirth. This is the case if your employee or their partner has agreed to be the primary carer, such as through an adoption or wh\u0101ngai agreement.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Duration of Bereavement Leave<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Your employees are entitled to three days of bereavement leave for the death of a close family member. A close family member is defined as a:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">child;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">grandchild;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">grandparent;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">parent;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">partner;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">partner\u2019s parent; or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">sibling.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">As an employer, you must pay your employees in full for these three days. Each employee is permitted to have three days off per bereavement that occurs.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Additionally, your employees can take one day of bereavement leave if someone close to them passes, such as a friend. This is discretionary. You should consider factors such as the nature of the relationship between your employee and the deceased when deciding if bereavement leave should be permitted. You can also account for whether your employee has any responsibilities in relation to funeral ceremonies. Most importantly, you should take due care and sensitivity when discussing such matters with your employees.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Further, you must permit your employees to take bereavement leave at any time. For example, they do not have to use their bereavement leave immediately after a death or for consecutive days.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Note that if you suffer more than one
