Under the Consumer Guarantees Act, if the goods are faulty or the services are sub-standard, consumers can seek:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">repairs;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">replacements; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">refunds.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">This article sets out what those guarantees are and what <\/span><a href=\"https:\/\/legalvision.co.nz\/business-structures\/start-a-business-in-new-zealand\"><span style=\"font-weight: 400\">your business<\/span><\/a><span style=\"font-weight: 400\"> must do to meet them.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">When the Consumer Guarantees Will Not Apply<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Consumer guarantees do not apply if:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">you are a private seller;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">you sell or supply commercial products or services, like hospital equipment or vehicles;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">your business sell goods that someone intends to resell;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the consumer fails to follow the instructions you or the manufacturer provided in a way that causes the problem;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the consumer loses or damages the goods after delivery; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">you made the consumer aware of particular faults before they bought the goods and provided what they asked for, but they changed your mind.<\/span><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Goods<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Under the Consumer Goods Act 1993 (the CGA), the meaning of goods includes most household items, such as:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">coffee machines;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">televisions; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">furniture.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">It also includes personal items, such as:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">animals; and&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">plants.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">It also covers:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">goods received as a gift;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">products that consumers hire; and&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">secondhand goods.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The CGA does not apply to:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">money;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">houses (but it does cover home repairs); or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">goods donated by a charity.<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Online Sales<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">If you sell goods online, you will have to meet the same requirements and guarantees as a physical retailer.&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Overseas Sellers<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">If you are based overseas and sell goods to consumers in New Zealand, the Consumer Guarantees Act might still apply, but it might be harder to rectify any problems.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">As a seller, you must guarantee that the goods will:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">be of acceptable quality;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">be fit for a particular purpose;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">match the description, sample or demonstration model;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">be a reasonable price;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">be owned by the consumer after purchase; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">arrive by the agreed time (or within a reasonable time if no time has been agreed) and in good condition.<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Manufacturers<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Manufacturers must make spare parts and repair facilities available for a reasonable period after they supply the goods. T<\/span>hey<span style=\"font-weight: 400\"> may also choose to provide an express guarantee with your products for a set period which is additional to the Consumer Guarantees Act guarantees. If they make these guarantees, they must honour it.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">All repaired, replaced or substituted goods will continue to receive the benefit of the express guarantee for the time remaining on the original guarantee period. After it expires, the guarantee under the CGA will continue to apply.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">If the goods you sell are manufactured outside New Zealand, and the
