However, you may need clarification on what this means in a legal context. A caveat is generally a warning that is often tied into a contract. It can also be connected to a title for land. There are many legal considerations if there is a caveat tied to the contract that you are entering into. This article will explain what a caveat is and why you might need one in New Zealand.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Caveat?<\/h2>\n\n\n\n<p>Caveat means \u2018warning\u2019 in Latin and is generally used to make someone aware about a particular consideration. In law it generally relates to a caveat on a property title. It is a notice that is posted against someone else\u2019s record of title for land. If you register the caveat then you are known as the caveator. It essentially means that the caveator has an interest in the land even though somebody holds title to that land.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Types of Caveats<\/h2>\n\n\n\n<p>There are many reasons why someone may want to <a href=\"https:\/\/legalvision.co.nz\/business-structures\/lodge-caveat-on-title\/\">lodge a caveat<\/a>. However, for someone to lodge a caveat, they must have a caveatable interest. There are many types of caveatable interests. These may include the interests of a:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>purchaser who has an unconditional agreement to purchase land;<\/li>\n\n\n\n<li>person who has the option to purchase land;<\/li>\n\n\n\n<li>mortgagee\/lender where there is an agreement to mortgage land;<\/li>\n\n\n\n<li>beneficiary who has an interest in land under a trust or estate;<\/li>\n\n\n\n<li>tenant with a lease of land unless there is no caveat clause in the lease.<\/li>\n<\/ul>\n\n\n\n<p>For example, a purchaser may buy a property with the settlement date being further in advance.
