This article will address your duties as an employer when an employee is injured at work.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">General Duty to Protect Health and Safety at Work<\/h2>\n\n\n\n<p>Employers have a general duty under the <a href=\"https:\/\/legalvision.co.nz\/employment\/how-to-ensure-your-new-zealand-workplace-is-safe\/\"><em>Health and Safety at Work Act 2015<\/em><\/a> (<a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/2015\/0070\/latest\/DLM5976660.html\">the Act<\/a>) to protect the health and safety of employees at work as far as \u201creasonably practicable\u201d.\u00a0<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p><span style=\"font-weight: 400\">What is \u201creasonably practicable\u201d means the employer must do everything they can in the given situation. This will depend on various factors, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">how common the risk occurs or the likelihood of the risk occurring;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the harms associated with the risk occurring are;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">the knowledge the employer has of the risk; and<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">what are the available methods of reducing or eliminating the risk of injury.<\/span><\/li>\n<\/ul>\n<\/div>\n\n\n\n<p>As such, employers have a duty to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>provide and maintain a risk-free work environment;<\/li>\n\n\n\n<li>ensure work equipment is safe to use;<\/li>\n\n\n\n<li>ensure work systems are safe;<\/li>\n\n\n\n<li>ensure facilities and processes for using, handling and storing equipment and substances are safe;<\/li>\n\n\n\n<li>provide all the necessary information, training, instructions and supervision so that employees can perform their relevant roles; and<\/li>\n\n\n\n<li>monitor the workplace to prevent injuries and illness.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Do Employees Have Health and Safety Duties?<\/h2>\n\n\n\n<p>Employees are also responsible under the Act to ensure their own health and safety and ensure their actions do not cause harm to others. This means they should follow any policies, procedures and reasonable instructions that management or their supervisors give.&nbsp;<\/p>\n\n\n\n<p>If a worker fails to comply with the health and safety rules of the workplace, you may choose to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>take disciplinary action;<\/li>\n\n\n\n<li>suspend their employment; or&nbsp;<\/li>\n\n\n\n<li>in After all, employers, principals and volunteer organisations fall under the category of a \u201cperson carrying on a business or undertaking\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Happens When a Worker Suffers an Injury at Work?<\/h2>\n\n\n\n<p>Workers can claim compensation under the Accident Compensation Corporation Scheme (ACC), where they receive 80% of their wages, called \u201cearnings-related compensation\u201d. The employer pays the first week of ACC compensation, and ACC makes any subsequent payments.&nbsp;<\/p>\n\n\n\n<p>If there has been a notifiable and serious event, you must also <a href=\"https:\/\/legalvision.co.nz\/employment\/notifying-worksafe\/\">report the injury<\/a> to <a href=\"https:\/\/www.worksafe.govt.nz\/\">WorkSafe New Zealand<\/a>. This may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>death; or<\/li>\n\n\n\n<li>serious illnesses and injuries.<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>These notifiable events must be related to the work site and not just occur when a worker is on-site. In addition, these usually must be serious work-related illnesses which require or would usually require immediate hospital admission.<em>\u00a0<\/em><\/p>\n<\/div>\n\n\n\n<p>If the injury or illness is not as serious, you must nevertheless record the injury within the business on an Incident and Injury Register. Failure to identify risks and reduce hazards in the workplace may also result in disciplinary action.
