Hence, whether you must pay out such leave depends on what you agreed on in the employment contract.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Alternative Holiday Pay Entitlements<\/h2>\n\n\n\n<p>If your employees have worked public holidays, they will likely have unpaid or untaken alternative holidays (also called day in lieu or time in lieu). You must pay any unpaid alternative holiday pay at the relevant daily pay (or average if they are salaried) that you would have paid them for on the last day of work. This means that if an employee was on a lower pay when the public holiday date occurred, the law entitles them to the rate of pay at the end of their employment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Deductions To Final Pay<\/h2>\n\n\n\n<p>Nevertheless, you might need to make deductions to an employee\u2019s final paycheck. This includes lawful deductions such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>PAYE tax;<\/li>\n\n\n\n<li>student loans;&nbsp;<\/li>\n\n\n\n<li>child support; and<\/li>\n\n\n\n<li>other deductions agreed upon in writing.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>However, deductions must be lawful and reasonable. That is to say:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>you should consult your employee before making a deduction;<\/li>\n\n\n\n<li>employees can vary or withdraw their written consent to deductions by giving notice at any time; and<\/li>\n\n\n\n<li>you must stop and vary the deductions within two weeks of receiving the notice if you have already made the deduction.<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--warning\">\n    <p>You should not make any deductions without written consent, as employees may take action with the Employment Relations Authority to recover the deduction, provided it is within six years of the deduction being made.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Severance and Redundancy Entitlements<\/h2>\n\n\n\n<p>If you have made an employee redundant, there may be a severance package or redundancy payment as part of the employment contract.
